ANJANA MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner Nos.1 Girja Devi and Petitioner No.3 Dharmnath Mahto, are apprehending their arrest in connection with Barauli P.S. Case No.136 of 2015 for allegedly having committed the offences under Sections 342, 366A, 372 and 120B of the Indian Penal Code.
Learned counsel for the petitioners submits that the present situation is that the victim girl has been recovered and she has stated in her statement before the Magistrate that she is a major and has married with Sanjay Kumar Mahto, brother of petitioner No.3 and son of Petitioner No.1, on her own sweet-
Patna High Court Cr.Misc. No.53921 of 2015 (7) dt.20-05-2016 2/2 will and she is willing to live in their family. Considering the fact that now the victim girl has herself expressed her willingness to live in the family of the petitioners, let Petitioner Nos.1 Girja Devi and Petitioner No.3 Dharmnath Mahto, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Pandey, learned Judicial Magistrate, 1st Class, Gopalganj, in connection with Barauli P.S.
