====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 12-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Warisaliganj P.S. Case No.10 of 2016 registered under Section 47 of the Excise Act.

On receiving the secret information about preparation of illicit country made liquor in village-Rasanpur, the informant alongwith other police officials reached there and, on search at nine places, it was found that illicit country made liquor was being prepared there. In the south of the village 20 liter illicit country made liquor alongwith other apparatuses, which are used for manufacturing the country made liquor, and 50 containers Chhowa

Patna High Court Cr.Misc. No.55708 of 2016 (2) dt.12-01-2017 2/2 was recovered. On query, it has come that in the said land, the furnace was being run by this petitioner.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended on the spot nor the said Bhutti/furnace was found running in the house of the petitioner or near the house of the petitioner. In fact, the petitioner is accused in one case bearing Warisaliganj P.S. Case No.262 of 2014 registered under Section 47(a) of the Excise Act, in which the petitioner is on bail, due to that reason, the petitioner has falsely been implicated in this case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Nawadah, in connection with Warisaliganj P.S. Case No.10 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
