2. The petitioner seeks bail in connection with Session Trial No. 91 of 2024 arising out of Mohiuddin Nagar P.S. Case No. 116 of 2023 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. As per the prosecution case, due to the instigation of the petitioner, the deceased has been assaulted by all the accused persons.

4. The specific allegation of assault is against Subodh Paswan (the petitioner) and Pramod Paswan. The petitioner is in jail since 08.10.2023.

5. Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.30459 of 2025(6) dt.02-09-2025 2/2 for bail.

6. Considering the aforesaid facts and circumstances as well as the fact that the petitioner is the assailant of the deceased, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is hereby rejected.
