JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-02-2018 The petitioner seeks bail in anticipation of his arrest in connection with Rafiganj P.S. Case No. 187 of 2017 dated 14.11.2017 instituted for the offences under Sections 30 (a), 38(I), 38(III) of the Bihar Prohibition and Excise Act, 2016. The house of one Manoj Singh was raided from where 542 litres of country made liquor was recovered. One Scorpio vehicle was found parked outside the house of Manoj Singh and from the vehicle, two bottles containing 375 ML each liquor was also found. The petitioner is said to be the owner of the aforesaid Scorpio vehicle. The petitioner has explained that he had given his vehicle to his driver for reaching one of his relatives to the Station but the driver played truant and carried liquor bottles in the vehicle. But for the fact that the petitioner is the owner of the
Patna High Court Cr.Misc. No.4791 of 2018 (2) dt.06-02-2018 2/2 vehicle in question, there is no other material to connect the petitioner with the aforesaid charge.
The petitioner does not have any criminal antecedents.
For the aforestated facts, the petitioner, above named is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to his furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Rafiganj P.S. Case No. 187 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
