2. The present writ petition has been filed for quashing the order dated 15.01.2015 passed by the respondent no. 5 by which the petitioner has been removed from service and pursuant to the order dated 22.09.2015 passed by respondent no. 2 has confirmed the order of respondent no. 5.

3. Learned counsel for the petitioner submits that the petitioner was initially appointed in the year 2011 on the post of Farmer Advisor (Kishan Salahkar) in the District of Bhojpur at

Patna High Court CWJC No.19252 of 2015 dt.04-01-2024 2/3 Piro Block. The allegation against the petitioner is that he has not distributed the amount which he has received in the month of December, 2014 and an enquiry was held on 09.01.2015 and thereafter, the petitioner has distributed the amount to the beneficiaries on 10.01.2015 as he claimed. But he has not annexed the list of the beneficiaries and even he has not stated anywhere in the writ petition on which date he has distributed the amount to the beneficiaries.

Learned counsel for the State on the other hand referred to the counter affidavit stating that the petitioner has received Rs. 1,31,000/- on 19.12.2014 but he has not distributed the same to the beneficiaries and after receiving the complaint from the local villagers an enquiry was held on 09.01.2015 in the presence of the petitioner and it was found that the petitioner has not distributed any amount to the beneficiaries. And the authority after considering the show cause filed by the petitioner has passed the impugned order. He further submits that there is no infirmity in the order and it is admitted fact that the petitioner has not distributed the said amount which he has received and apart from the aforesaid the petitioner was on contractual basis, so the authority has rightly disengaged the petitioner.
