JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Goh P.S. Case No. 46 of 2017, registered under Sections 341, 323, 308, 504 and 506/34 of the Indian Penal Code. The accusation is that when pig of the petitioners entered into the house of the informant then wife of the informant made protest, on which, petitioner started to abuse and cause injury to his wife and son, Ranjit Das. Later on, informant reached at his house and accompanied his wife and son for treatment in the hospital.

Learned counsel for the petitioner submits that while the occurrence is said to be taken on 29.04.2017, but he F.I.R. has

Patna High Court Cr.Misc. No.47009 of 2017 (2) dt.22-09-2017 been lodged on 02.05.2017. Moreover, the injuries, as found on the person of the wife and son of the informant, are simple in nature.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Daud Nagar, in connection with Goh P.S. Case No. 46 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
