JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379, 448, 341, 323, 504, 509, 147 of the Indian Penal Code.
It is alleged that the FIR named accused persons and some unknown entered into the house of the informant and tried to outrage the modesty of the sisters of the informant and took away articles.
It is submitted by learned counsel for the petitioner that neither petitioner is known to the family members of the informant prior nor he is named in the FIR and, subsequently, the petitioner is named by the informant since he is his next door neighbor. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
