JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 380, 448, 504 and 506/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
The prosecution case is that the FIR named accused persons including 3-4 unknown came armed with pistol and rifle and started smashing the hutment of the informant when on the order of petitioner no.3, petitioner no.1 took away the articles from the house of the informant, made assault to the informant and abused by calling caste name.

No.55647 of 2015 (2) dt.08-12-2015 2/2 It is submitted by learned counsel for the petitioner that for the occurrence of 25.02.2015, the FIR was registered on 31.03.2015 whereas there is counter version of the occurrence also. The petitioners' side filed Complaint Case No. 52C of 2014 against the informant and others at earlier point of time. Considering the delayed lodging of the case and the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 2nd, Nalanda in connection with SC/ST P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
