The petitioner apprehends his arrest in connection with Madhubani Town P.S. Case No.292 of 2016/G.R. No.1580 of 2016 registered under Section 379 of the Indian Penal Code. Regarding the theft of the motorcycle of the informant, the present case was lodged on 25.07.2016 against unknown. Learned counsel appearing on behalf of the petitioner submits that after lodging of the present case, the police officials of Darbhanga Sadar Police Station apprehended Prabhakar Kumar Singh on which the petitioner was found sitting and, thereafter, Darbhanga P.S. Case No.315 of 2016 under Section 414 of the
Patna High Court Cr.Misc. No.48089 of 2017 (2) dt.13-10-2017 2/2 Indian Penal Code was instituted in which Prabhakar Kumar Singh gave his confessional statement to the effect that he has stolen the motorcycle with the help of Ganesh Yadav. He did not disclose the name of the petitioner but the petitioner was remanded in the judicial custody in connection with the aforesaid case and was released after 15 days. Thereafter, the confessional statement of the petitioner was recorded by the police in the present case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No.292 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
