====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 06-05-2025 Heard Mr. Santosh Kumar Singh, learned counsel appearing on behalf of the petitioners and Mr. Chandra Bhushan Prasad, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Alauli P.S. Case No. 373 of 2024 registered for the offence punishable under Sections 326(G), 85, 352, 351(2) and 3(5) of the BNS, 2023.
3. Allegation against the petitioners is of subjecting the informant to torture due to non-fulfillment of demand of dowry.
4. Learned counsel appearing on behalf of the petitioners submitted that the petitioner no.1 is the brother-inlaw (bhaisur) of the informant and petitioner no.2 is the son of
Patna High Court CR. MISC. No.27109 of 2025(2) dt.06-05-2025 2/2 petitioner no.1. They have no concern with the matrimonial relationship of the informant and her husband who is the own brother of petitioner no.1.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

Considering the nature of allegation made against the petitioners who are brother and nephew of the husband of the informant, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria in connection with Alouli P.S. Case No. 373 of 2024, subject to the condition as laid down under Section 482(2) of the BNSS, 2023.
7. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
8. The bail application stands disposed of.
