JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-11-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Rampur P.S. Case No. 236 of 2017 registered for the offence punishable under section 307 and other sections of the Indian Penal Code. Learned counsel appearing for the petitioners submits that they have been falsely implicated in this case as a civil dispute is going on between the parties with regard to encroachment. The encroachment was removed in the year 2015 and at the instance of enemies that the father of the present petitioners was instrumental in removing the encroachment, the present case has been lodged. Moreover, all the injuries sustained have been found to be simple in nature.
Learned Addl. P.P. appearing for the State opposes the
Patna High Court Cr.Misc. No.49374 of 2017(3) dt.21-11-2017 2/2 prayer for bail and submits that informant has sustained as many as 12 injuries which shows that he was brutally assaulted by these petitioners. During investigation, several witnesses have supported the prosecution case.
Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioners. The same is, therefore, rejected.
