The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 323, 337, 338, 332, 353, 307, 188 of the Indian Penal Code and Section 3 of Epidemic Disease Act, 1897.

As per the prosecution case, this petitioner alongwith other F.I.R. named accused and 15 unknown persons, lashed with lathi, danda, bricks and stones, became violent and attacked on the police party, due to which, some of the police personnel sustained injuries.

It is submitted on behalf of petitioner that allegation of assault is general and omnibus. No specific overt act has been alleged against this petitioner. Petitioner is said to be member of the mob and has got clean antecedent.

Patna High Court CR. MISC. No.27280 of 2022(2) dt.22-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances as well as clean antecedent, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - X, Patna in connection with Patliputra P.S.
