The petitioners are apprehending arrest in a case registered for the offences punishable under sections 384,386,323 and 380/34 of the Indian Penal Code.

The prosecution case is that the accused persons came to the grocery shop of the informant and demanded ten thousand rupees as donation on the eve of Durgapuja. Subsequently, they were given one thousand and thereafter five hundred. Thereafter the accused persons again demanded rest eight thousand five hundred and on refusal of the same the informant was assaulted and rupees four thousand five hundred was taken

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. It is further submitted that on the even of Durga Puja there was some dispute with regard to donation with Durgapuja Samiti.

Considering the nature of accusation and the fact that the petitioners have no criminal antecedent, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Magadh Medical P.S. Case No. 141 of 2015 pending in the court of learned ACJM, IV, Gaya. This application is disposed of with the aforesaid observation/direction.
