2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 85 , 115 ( 2 ), 117 ( 2 ), 126 ( 2 ), 76, 303 ( 2 ), 352, 351 ( 2 ), 351 (3) , 3(5) of BNS. 3 . As per prosecution case , informant was married to co-accused Manoj Kumar about 10 years ago and after the marriage , she was subjected to cruelty and torture by all the accused persons named in the F.I.R., due to non-fulfillment of demand of dowry .
4. Petitioner is brother-in -law of victim. He is simply victim of over implication . He is separate in mess and
Patna High Court CR. MISC. No.24858 of 2025(2) dt.05-05-2025 2/2 property . There is no specific allegation alleged against him and he has got no concern with the affairs of couple . It is further orally submitted by learned counsel for the petitioner that thrust of accusation is against the husband of the informant. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .

Considering the aforesaid facts , clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within six weeks from today, let this petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM Khagaria in connection with Mahila P . S. Case No . 52 of 2024 , subject to the conditions laid down under section 482 ( 2 ) od BNSS 2023 .
