For quashing the order dated 30.07.2008 passed by the learned Sub Judge Ist, Bhagalpur in Title Suit No.270 of 1999 whereby and whereunder the application of the petitioner dated 18.06.2008 was rejected and thereby refused to allow the petitioner to adduce his evidence."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to raise the issue, raised in the present writ petition, before the learned court below.
