JUSTICE RAJIV ROY ORAL ORDER 23-03-2023 No one appears on call on behalf of the petitioner although learned APP for the State is present. The present petition has been preferred for quashing of the order dated 28.08.2015 passed by learned A.C.J.M., Nalanda in Rajgir P.S. Case No.103 of 2013 whereby and whereunder took cognizance under Sections 328, 304B/14 of the Indian Penal Code.

The allegation in the FIR is that the informant's daughter was married to the petitioner in the year 2010 but was being tortured for dowry and subsequently it is alleged that she was administered poison causing her death.

Considering the kind of allegation no interference is required.

The petitioner will have liberty to raise all the points

Patna High Court CR. MISC. No.56582 of 2015(2) dt.23-03-2023 2/2 before the Trial Court at an appropriate stage. As such, the petition stands dismissed.
