JUSTICE SHAILENDRA SINGH ORAL ORDER 06-05-2025 Heard Mr. Yogesh Chandra Verma, learned counsel for the petitioner and Mr. Sanjay Kumar Tiwary, learned APP for the State.

2. Petitioner seeks regular bail in connection with Vaishali Mahila P.S. Case No. 09/ 2025 dated 22.02.2025 registered for the offence(s) punishable under Section(s) 64, 81 and 352 of the BNS.

3. The main submissions advanced by the learned senior counsel appearing for the petitioner are that the FIR lodged by the informant, the so-called victim, itself goes to show that the informant was 27 years old when the FIR was lodged and she admitted her love affair with the petitioner running since the year 2017, though, she made the allegation that on the pretext of marriage the petitioner established sexual relation with her but the said allegation is completely unbelievable in view of the informant's majority and her age

No.25445 of 2025(2) dt.06-05-2025 2/2 and further, she remained silent for eight years and did not make any resistance against the said relationship and she filed her case with an intention to create pressure upon the petitioner. It is lastly submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 23.02.2025.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the facts and circumstances of this case as well as the aforesaid submissions advanced by the petitioner's counsel and mainly the fair and clean antecedent of the petitioner as well as nature of allegation appearing against him, also coupled with the petitioner's custody period, this court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Vaishali Mahila P.S. Case No. 09/ 2025 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
