JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 25-02-2016 Heard the counsel for the petitioner and the State. The petitioner herein seeks anticipatory bail in Warisaliganj P.S. Case No. 62 of 2015 punishable under Sections 304(B)/34 of the Indian Penal Code.

After some arguments, the counsel for the petitioner seeks to withdraw the application, enabling him to move the court below and place all relevant facts/materials collected in course of the investigation, which according to him, supports his defence.

The application is dismissed as withdrawn.

The petitioner may surrender and pray for regular bail which shall be considered and disposed of on its own merit in accordance with law.
