The petitioner apprehends his arrest in Mehsi P.S. Case No.24 of 2016 registered under Sections 420, 409, 353 and 34 of the Indian Penal Code.

The informant alleged that the petitioner being Panchayat Sachiv of Chaklalu Kasba Mehsi and Mirjapur did not hand over the charge of records with regard to appointment of Panchayat teachers.

The learned counsel for the petitioner submits that the petitioner was transferred from Chaklalu Kasba Mehsi and Mirzapur Panchayat on 08.08.2010. The petitioner handed over the charge of both the panchayats to Rameshwar Singh on

Patna High Court Cr.Misc. No.11500 of 2018 (3) dt.08-03-2018 08.08.2010. The list of documents handed over by the petitioner to his successor is annexed as Annexure 2. The petitioner is not at all responsible for non-availability of the register and record with regard to appointment of panchayat teachers of the aforesaid two panchayats but petitioner has also been made accused. Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaan, Motihari in connection with Mehsi P.S. Case No.24 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
