The petitioner is apprehending his arrest in connection with Complaint Case No.1191 of 2017 , registered for offences punishable under Sections 406, 420, 467, 468, 471 of the Indian Penal Code.

Allegation against the petitioner is that on inducement of doubling the amount, the informant deposited the amount and on maturity, he refused to pay back the amount. Submission of the learned counsel for the petitioner is that there is no statement in the complaint petition as to how much amount was taken and what will be the value on maturity and a vague allegation has been mentioned and earlier also a

Patna High Court CR. MISC. No.26962 of 2019(2) dt.25-04-2019 2/2 case had been lodged by the wife of the complainant with respect to deposit of Rs.3,000/- but in that he has been acquitted after full trial , which will appear from Annexure-2 and the other two accused persons have been granted privilege of anticipatory bail in the present case by a Co-ordinate Bench of this Court.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1st Class, Muzaffarpur in connection with Complaint Case No.1191 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
