The writ application is filed to question selection of respondent no. 6 as Sachiv of Jal Chhajan Samiti which is a post created on honorarium basis under the Integrated Watershed Management Programme.

The respondent nos. 1, 2, 4 and 5 have filed a counter affidavit. A.C. to A.A.G.-III has drawn attention of the Court to Annexure-A which is the merit list prepared by the Panchayat wherefrom it appears that Respondent no. 6 was placed at Sl. No. 1 whereas the petitioner was placed at Sl. No. 2. The reason for placement of the respondent no. 1 at Sl. No. 1 and

Patna High Court CWJC No.2128 of 2014 (2) dt.28-07-2016 2/2 thereafter his engagement as Sachiv of Jal Chhajan Samiti have been spelt out in paragraphs 5 and 6 of the counter affidavit. I am satisfied from perusal of the stand taken by the respondents that no palpable illegality, as such, has been committed in engagement of respondent no. 6 on the post in question.
