JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 The present application has been field for modification of the order dated 09.10.2015, passed in Cr. Misc. No. 40388 of 2015.

The petitioner was granted anticipatory bail in connection with Akorhi Gola P.S. Case No. 44 of 2015, registered for the offences under Section 406, 409, 420 of the Indian Penal Code. The petitioner was to deposit 20% of the alleged amount of Rs. 22, 40,0000/- within a period of four weeks from the date of receipt/production of a copy of this order.

It is submitted by the learned counsel for the petitioner that the petitioner surrender, but the authority before whom the deposit was made, it was not mentioned in the order, hence the petitioner could not deposit the aforesaid

Patna High Court Cr.Misc. No.55785 of 2015 (2) dt.09-12-2015 amount and he was not allowed to furnish the bail bonds. In this circumstance, the present modification application has been filed.

Let the petitioner deposit 20% of the alleged amount Rs. 20,40000/- within a period of three weeks before the Bihar State Food and Civil Supplies Corporation Limited, Patna through Bank Draft and the time for surrender of the petitioner is extended by further three weeks. Accordingly the order dated 09.10.2015 is modified to the above extent.
