This application, for grant of anticipatory bail, arises out of Khagaria P.S. Case No. 410 of 2017 disclosing offences under Section 427 of the Indian Penal Code and Section 136 of the Electricity Act, Section 3 of Prevention of Damage to Public Property Act.

It is alleged that in course of patrolling, the informant, who is Junior Electric Engineer, Electric Supply Sub Division, Khagaria (Rural), found one iron Electric pole and L.T. Wire which had fallen on the ground and on query from the near by persons it came to light that petitioner was responsible for the same.

Learned counsel for the petitioner has submitted that

No.46326 of 2017 (2) dt.22-09-2017 2/2 petitioner's implication is based on the information furnished by the nearby local people, whose names have not been mentioned in the F.I.R. Petitioner has no criminal antecedent. Considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 410 of 2017 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
