2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
3. As per allegation in the FIR, while the informant was going to C.S.P. Dharhara Hemajapur center of Punjab National Bank with an amount of Rs. 5,50,000, which he had withdrawn from Barachatti Branch, petitioner with other two unknown miscreants came on a motorcycle and intercepted the motorcycle of the informant. On the point of arms, snatched his total amount and fled away.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case.
Patna High Court CR. MISC. No.28596 of 2024(2) dt.26-04-2024 2/2 Informant has denied before the police for conducting the TIP of the accused persons. His name surfaced on the basis of confessional statement of co-accused Vishal Kumar. Nothing has been recovered from his conscious possession. Petitioner is languishing in judicial custody since 10.01.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 2nd, Gaya in connection with Barachatti P.S. Case No. 297 of 2023.
