2. Petitioner seeks regular bail in connection with Special Vigilance Case No. 6 of 2026 arising out of Amour P. S. Case No. 310 of 2025 registered for the offences punishable under Sections 7(a), 12 of the Prevention of Corruption Act.
3. On a complaint, filed by one Md. Munazir, before the District Magistrate, Purnea against this petitioner, who is working as Executive Assistant at Anchal Office, with an allegation to demand money for issuance of residential certificate. Thereafter, the matter was inquired and it was found that 68 transactions has been done between 11.06.2025 to 16.07.2025 in bank account of this petitioner and other
Patna High Court CR. MISC. No.27011 of 2026(3) dt.17-07-2026 2/3 transaction has also been done in the bank account of wife of this petitioner. Further, Rs. 1400/- and 20 residential certificate form were also recovered from the possession of this petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner claims clean antecedent and is in custody since 05.01.2026. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State as well as learned counsel for the vigilance vehemently opposed the bail application.
6. Considering clean antecedent, period of custody and the fact that charge-sheet has been submitted, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Vigilance), Bhagalpur in connection with Special Vigilance Case No. 6 of 2026 arising out of Amour P. S. Case No. 310 of 2025 with following conditions:
"1. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the
Patna High Court CR. MISC. No.27011 of 2026(3) dt.17-07-2026 3/3 court below, and on his absence on two consecutive dated without sufficient reason, his bail-bond shall be cancelled by the court below.
2. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at libery to move for cancellation of bail."
