JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. There is general and omnibus allegation against the petitioners to have committed assault and theft. Specific allegation of commission of injury at the head of the informant is against coaccused Md. Saquib, who is already in custody as submitted by learned counsel for the petitioners. There is case and counter case also.

Learned counsel for the informant opposed the prayer

Patna High Court Cr.Misc. No.51971 of 2016 (2) dt.20-12-2016 2/2 for bail on the ground that injury report would reveal that other injured have also sustained injury at the head. Considering the aforesaid facts specially the fact that the allegation is general and omnibus, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Purnea/Successor Court in connection with Dagarwa Police Station Case No. 72 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
