JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Manigachhi (Bajitpur O.P.) P.S. Case No.194 of 2017 registered under Sections 341, 323, 324, 307, 379, 427, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that so far as petitioner no.1 is concerned, there is an allegation of giving one knife blow which caused injury on the left hand of Ranjeet Sah which is simple in nature. The alleged injury of Rajesh Sah caused by petitioner no.2 by brick is also said to be simple in nature. It is submitted that both parties are own gotiyas and they

Patna High Court Cr.Misc. No.8662 of 2018 (2) dt.20-02-2018 are fighting for a land dispute. It is also submitted that the petitioners have no criminal antecedent.

Considering the facts and circumstances of the case particularly that the petitioners and the informant are said to be gotiyas, there is a land dispute and the nature of injury is simple and not on the vital part of the body, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Darbhanga, in connection with Manigachhi (Bajitpur O.P.) P.S. Case No.194 of 2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
