JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections341, 323, 307, 34 of the Indian Penal Code.
The fact of the case, in brief, is that on the alleged date of occurrence, the brother of the informant was trying to throw out the rainwater on which, it is alleged that the accused persons named in the FIR including the petitioner stopped him and altercation took place in between the parties and in the meantime accused Shankar Ram, who was armed with a cricket bat started assaulting the informant and his wife. Accused Bharat Kumar Ram with an intent to kill him assaulted on his head with Farsa due to which the informant seriously injured. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.50143 of 2016 (2) dt.22-11-2016 2/2 petitioner has no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. It is a case and counter case. No specific allegation has been made against the petitioner. General and omnibus allegation has been made against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in Mojahidpur P.S.Case No. 155 of 2016,subject to the conditions as laid down u/s 438(2) Cr.P.C.
