Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Aurangabad Town P.S. Case No. 396 of 2021 registered for the offence under Sections 15, 18, 19 and 29 of the NDPS Act. Learned counsel for the petitioner submits that the petitioner is in custody since 13.09.2021 and similarly situated co-accused has been granted bail by this Court vide order dated 02.01.2023 passed in Cr. Misc. No. 21504 of 2022. Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.29071 of 2023(2) dt.24-05-2023 2/2 Considering the fact that the similarly situated coaccused has been granted bail, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Aurangabad/concerned Court below in connection with Aurangabad Town P.S. Case No. 396 of 2021, subject to the following conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond shall be liable to be cancelled.
