The petitioner apprehends his arrest in connection with Araria P.S. Case No. 663 of 2016 registered under Sections 420, 406 and 409/34 of the Indian Penal Code. Allegedly, the petitioner in collusion and conspiracy with other co-accused defalcated the amount, which was meant for distribution of scholarship amongst S.C./S.T. and E.B.C. students. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no concern in receiving the amount and he has falsely been made accused in this case. Further submission is that similarly situated co-accused persons namely, Sri Kailash Paswan, Sri Sanjeev Thakur, Vijay Kumar

Patna High Court Cr.Misc. No.377 of 2017 (3) dt.27-01-2017 2/2 Singh, Chandan Kumar Sada and Manoj Sada have already been allowed anticipatory bail by different Benches of this Court vide Cr. Misc. Nos. 53342 of 2016, 49976 of 2016 and 54052 of 2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Araria in connection with Araria P.S. Case No. 663 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
