2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 25(1-A), 25(1-AA), 25(1-B), 25(1-C), 26 and 35 of the Arms Act.

3. The allegation against the petitioner along with others is of engaging in manufacturing of illegal Arms in a field. It is further alleged that on search of that field, there has been recovery of many incriminating articles. On seeing the police personnel, four accused persons managed to escape from the place of occurrence.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner was not apprehended on spot

Patna High Court CR. MISC. No.29093 of 2024(2) dt.26-04-2024 2/2 neither anything was recovered from his conscious possession or from his house. The name of the petitioner has come into light on the basis of disclosure made by local chaukidar. The petitioner has no concern with the alleged recovery and or with the place of occurrence. Similarly situated other accused person has already been enlarged on bail by this Court vide order dated 20.02.2024 passed in Cr. Misc. No. 7761 of 2024. He is languishing in judicial custody since 19.01.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as the period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada (Town) P.S.
