Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
This is the second modification application with a prayer to modify the order dated 26-06-2020 passed in Cr. Misc. No. 13802 of 2020.
The first modification application vide Cr. Misc. No. 8988 of 2021 was allowed by order dated 10-02-2021 and further six weeks' time was granted to the petitioner to surrender in the court below.
Now the second modification application has been filed for
Patna High Court CR. MISC. No.32836 of 2022(2) dt.06-07-2022 2/3 modification of the order dated 26-06-2020 passed in Cr. Misc. No. 13802 of 2020 by which the petitioner was granted anticipatory bail in connection with Korha P.S. Case No. 342 of 2019 pending in the court of learned Sub Divisional Judicial Magistrate, Katihar.
It is submitted on behalf of the petitioner that though the petitioner was granted further six weeks' time to surrender in the court below by order dated 10-02-2021 passed in Cr. Misc. No. 8988 of 2021 but due to Covid-19 pandemic, the petitioner could not surrender within the stipulated time. It is further prayed on behalf of the counsel for the petitioner that further time may be extended so that the petitioner could surrender in the court below.
Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is again extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 26-06-2020 passed in Cr. Misc. No. 13802 of 2020.
