Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 20(b)(II)(B) of N.D.P.S. Act 1988, Section 414 of the Indian Penal Code and Sections 25(1B) and 26(1) of the Arms Act. 3.

The learned counsel for the petitioner submits that petitioner has antecedent of four cases and he had approached this court seeking regular bail in the instant case by filing Cr. Misc No. 57662 of 2021 and the same was allowed by an order dated 3-3-2022 -- with the condition that one of the bailors of the petitioner shall be his father, namely, Surendra Singh, and in the event, if the petitioner is implicated in a case of similar nature, the learned trial court shall forthwith cancel the bail

The learned counsel submits that petitioner after his release could not attend the case on six dates as such his bail bonds were cancelled and thereafter the petitioner surrendered on 29-2-2024. It is submitted that petitioner undertakes that in the event if regular bail is granted, he will not misuse the privilege.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sheohar P.S. Case No. 193 of 2021.

One of the bailors of the petitioner shall be his father, Surendra Singh.

Further, if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay
