JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-03-2023 The present writ petition has been filed seeking the following relief:- "That this is an application on behalf of the petitioner for issuance of an appropriate writ Writs, order/orders, direction/directions for the respondents specially respondent no. 10 and 11 to remove the encroachment/obstruction over the land

Patna High Court CWJC No.19244 of 2015(2) dt.28-03-2023 2/2 of old plot no.206 new Khata No.121 plot No.457, 461 and 480 area of 11 Katha situated at MohallaMadhubani ward No.11, Khata No.11, P.S. K. Hat District-Purnia without any further delay and also direct the official respondents to ensure not to disturb the peaceful possession of the petitioner over the land in question by the private respondents as well as anti-social elements over the aforesaid Land taking into consideration that the aforesaid 2 Land has been purchased through registered sale deed by his mother namely Smt. Pramila saha from Sri Lal Mohan Singh and for other necessary relief (s) for which he may found fit in accordance with law."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
