JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-01-2021 Heard learned counsel for the petitioners and Mr. Akhileshwar Dayal, learned A.P.P. for the State. Petitioners, in the present case, are seeking regular bail in connection with Bhagwanganj P.S. Case No. 76/2018 registered for the offence under Section 304(B) of the Indian Penal Code.

Mr. Akhileshwar Dayal, learned A.P.P. for the State has gone through the case diary. He has submitted before this court that in the case diary all the witnesses are relatives of the informant, there is no independent witness and on query made by this court as to whether any of the witnesses have made any specific allegation against the petitioners, learned A.P.P. submits that there is no specific allegation and the allegations are only

Considering the aforesaid facts and circumstances of the case and in the nature of the materials placed before this Court, as the petitioners are the younger brother of the husband and the mother of the husband respectively, let the provisional bail granted to them be confirmed.

The petitioners shall be allowed to remain on bail on the same bail bond.
