JUSTICE ARUN KUMAR JHA ORAL ORDER 07-05-2025 Heard learned counsel for the petitioner as well as learned APP for the State and learned counsel appearing on behalf of the informant.

2. In the present case, the petitioner seeks bail in connection with Rampurhari P.S. Case No. 216 of 2024 registered for the alleged offences under Sections 137(2), 87, 3(5) of B.N.S.

3. As per prosecution case, the daughter of the informant went missing and the informant came to know about the petitioner who took her daughter away with the help of some other co-accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

However, in statement recorded under Section 183 B.N.S.S. she stated that she left her house to appear in the examination and on way the petitioner boarded on the auto and put a handkerchief on her mouth and thereafter, she became unconscious. But in her statement the victim girl has not stated that the petitioner committed any wrong with and it appears that she has given the statement upon the pressure of her parents. Learned counsel further submits that the petitioner is a student and has been implicated in this case by the informant to ruin his future. The petitioner has got no criminal history. The petitioner is in custody since 28.12.2024 and charge sheet has been submitted.

5. Learned APP as well as learned counsel appaering on behalf of the informant vehemently oppose the submission made on behalf of the petitioner. Learned counsel for the petitioner submits that the victim girl stated before the learned Magistrate that she was made unconscious by the petitioner by putting a handkerchief on the mouth of the victim girl and taking her away to Delhi. Earlier also the petitioner threatened the victim girl.

6. Having regard to the facts and circumstances and

No.27969 of 2025(2) dt.07-05-2025 3/3 submissions made on behalf of the parties and considering the submission of charge sheet, period of custody of the petitioner and his clean antecedent, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class (East), Muzaffarpur/concerned Court in connection with Rampurhari P.S. Case No. 216 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
