Petitioner apprehends his arrest in connection with Raghunathpur P.S. Case No.178 of 2021, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354 and 34 of the Indian Penal Code.

The petitioner is said to have assaulted Matishari Devi, the aunt of the informant by means of lathi causing grievous injuries on her back and waist.

Learned counsel for the for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the allegation of theft is totally false and fabricated to make the case serious in nature.

Patna High Court CR. MISC. No.26858 of 2022(3) dt.19-12-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that due to assault made by the petitioner, the aunt of the informant sustained grievous injury, I am not inclined to enlarge the petitioner on anticipatory bail.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
