JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 384 and 120B of the Indian Penal Code.
The prosecution case is that one Bhola Nath Mistra purchased certain piece of land from one Fatebahadur Singh and Punam Devi. Subsequently, said Bhola Natha Mitra executed one registered "Power of Attorney" on 26.07.2013 in favour of the informant before the Additional District Sub Registrar, Howrah, with regard to 16 katha and 8 katha of land and. On that basis, the informant executed sale deed on 14.02.2015 and 05.06.2015. Subsequently, the informant came to know that for the same piece of land one sale deed was also executed by said Bhola Nath Mitra on 23.05.2015 in favour of Bhagwan Singh, Jainath Verma and
Patna High Court Cr.Misc. No.57081 of 2015 (2) dt.18-12-2015 2/2 Kripal Singh, wherein Manoj Kumar Singh, Ramjee Singh were the identifiers. It is alleged against the petitioner that he was also a part of purchase.
It is submitted by learned counsel for the petitioner that no Will was executed in favour of the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the thrust of accusation against co-accused persons, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri, Rohtas in connection with Dehri (Town) P.S. Case No.283/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
