JUSTICE HARISH KUMAR ORAL ORDER 15-11-2022 Heard Ms. Kirti Sharma, learned counsel appearing on behalf of the petitioner as well as Mr. Ranjeet Kumar Pandey, learned counsel for Patna Municipal Corporation.

The only grievance of the petitioner is with regard to non payment of monthly pension to the petitioner for the months of August, September, October and November 2019, which has remained unpaid without any fault on his part.

It is submitted on behalf of the learned counsel for the petitioner that though, the petitioner superannuated from the post of Cashier of New Capital Circle on

Patna High Court CWJC No.11256 of 2021(2) dt.15-11-2022 2/3 31.10.1999 and thereafter, he has been allowed regular monthly pension, however, on account of no reason he has not been paid his monthly pension for the month of August, September, October and November 2019. It is next contended that for ventilating his grievance, he also filed representation before the respondent no. 2 but to no avail. At this stage, learned counsel for the Municipal Corporation submits that if, the petitioner would represent before the respondent no. 2 by filing fresh representation along with the materials in support of his claim, the grievance of the petitioner would be redressed.

Having considered the submissions made on behalf of the parties, the present application is disposed of with a direction to the petitioner to file a representation before the Respondent Municipal Commissioner, Municipal Corporation, Patna within a period of four weeks. If such a representation is filed, the respondent shall consider the same and pass a speaking order for payment of the arrears of monthly pension , if not paid in accordance with law.

Accordingly, the present writ application stands
