JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Patepur P.S. Case no. 63 of 2016, registered under Sections 304(B), and 201/34 of the Indian Penal Code.

The accusation of killing of the daughter of the informant by her husband and in-laws due to non-fulfillment of demand of she buffalo and her dead body has been disposed of. Learned counsel for the petitioner submits that petitioner is the husband of the deceased. Further submission is that, in fact, deceased, wife of the petitioner, died due to illness and father of his wife was also participated in the funeral, but later on with ulterior motive and illegal gain the informant lodged the complaint Case No. 1602 of 2016, after ten days of the occurrence, in the Court of Chief Judicial Magistrate, Vaishali, Hajipur, which was forwarded under

Patna High Court Cr.Misc. No.46600 of 2017 (2) dt.22-09-2017 2/2 Section 156 of the Cr.P.C. and after realizing the mistake the informant has filed an application in the Court of Chief Judicial Magistrate, Vaishali detailing the real fact. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Hajipur in connection with Patepur P.S. Case No. 63 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
