JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Laukahi P.S. Case No. 194 of 2019, registered under Sections 341, 323, 325 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 06.09.2019, Malti Devi, wife of Manoj Yadav, daughter-in-law of informant Ram Lochan Yadav, was removing grass on ditch, at that time, his another son Parmod Yadav (Petitioner) made complaint saying that the said ditch is belonging in his field, on which hot talk exchanged and in that course, Parmod Yadav caused fracture injury at her hand. Thereafter, again, on 07.09.2019, at about 02.00 P.M. when Malti Devi was present at her door at that time, petitioner Parmod Yadav, having pistol in his

Patna High Court CR. MISC. No.25773 of 2020(3) dt.02-12-2020 2/2 hand, and his wife Indu Devi came and on the behest of Indu Devi, Parmod Yadav fired causing injury at her hand. Thereafter, Malti Devi was rushed for treatment. Learned counsel appearing for the petitioner submits that due to land dispute, the present case has been lodged against petitioner and his wife Indu Devi, another son and daughter-in-law of informant. Further submission is that while in medical examination, injury is lacerated in nature 1"X1/2"X1/4", but opinion regarding the nature of injury has not been detailed. Moreover, compromise petition has been filed by the informant and injured on 22.11.2019 in the Court of S.D.J.M., Jhanjharpur. The petitioner is in custody since 06.01.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 194 of 2019.
