The petitioner apprehends his arrest in connection with Azimabad P.S. Case No. 04 of 2016 registered for the offences punishable under Sections 341, 323, 504, 506(34) of the Indian Penal Code and Section 27of the Arms Act.
Learned counsel for the petitioner submits that the father of the petitioner was killed by the informant's side and to put pressure this false case has been lodged. It is strange that the petitioner opened fire but no injury was caused to the informant and further the petitioner did not repeat the same. The allegation appears to be concocted and false and as such the petitioner deserves sympathetic consideration.
Learned APP after going through annexure-2 fairly
Patna High Court Cr.Misc. No.35454 of 2017 (2) dt.11-08-2017 submits that the father of the petitioner was killed and for that Azimabad P.S. Case No. 51 of 2015 is going on. In the facts and circumstances stated above, the petitioner above named, in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Dinakar Kumar, Judicial Magistrate, Ara in connection with Azimabad P.S. Case No. 04 of 2016, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
