JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Petitioner is named in the first information report but only suspicion has been raised against him as none had seen the actual killing of the deceased. Moreover, co-accused has already been granted privilege of bail by In-charge learned Additional Sessions Judge, Jamui vide order dated 16.2.2019 but it is very sad to note here that learned Additional Sessions Judge 1st, Jamui, did not take note of the order dated 16.2.2019 passed by In-charged learned Additional Sessions Judge, Jamui, and rejected the bail prayer of the petitioner.

Considering the aforesaid facts and circumstances as

No.24662 of 2019(2) dt.19-04-2019 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui / concerned court in connection with Lakshmipur P.S. Case No. 200/2018.
