2. Petitioner seeks regular bail in connection with Rajepur P. S. Case No. 12/2025 in a case registered for the offences punishable under Section 111(4) of the Bharatiya Nyaya Sanhita and Section 30(a) of Bihar Excise Act.

3. As per prosecution case, 2565 litres illicit liquor was recovered from seized Truck bearing Reg. No. UP12-BT1852.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that petitioner is neither owner nor driver of seized vehicle. Nothing has been recovered from conscious possession of petitioner. Petitioner is in custody

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 3, Motihari, East Champaran in connection with Rajepur P. S. Case No. 12/2025.
