JUSTICE SUDHIR SINGH ORAL ORDER 24-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 323, 341, 498-A and 379 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act. Allegation against the petitioner is that he along with other family members assaulted and tortured informant and kept ornaments amounting to Rs.30,000/- due to non-fufilment of demand of dowry.
It is submitted on behalf of the petitioner that he is ready to keep opposite party no. 2. Learned counsel for opposite party no. 2 is also present in Court and has expressed that opposite party no. 2 is willing to reside with petitioner.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Jamui, in connection with Mahila
Patna High Court Cr.Misc. No.55650 of 2015 (3) dt.24-02-2016 2/2 Thana P.S. Case no. 63 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The court below is directed to issue notice upon opposite party no. 2 fixing a date. Petitioner on that date shall also be present in the court.
