Petitioners seek bail in Bithan P.S. Case No.10 of 2019 instituted for the offence under Section(s) 30(a), 30(f) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that total 667.080 litres foreign liquor has been recovered from the Bolero Pickup Van in which petitioners are said to have been found sitting. Counsel for the petitioners submits that they are in custody since 07.02.2019 having clean antecedents. They have no concern with the aforesaid liquor. They were sitting in the

Patna High Court CR. MISC. No.25133 of 2019(2) dt.22-04-2019 2/2 vehicle merely as passenger.

Keeping in view the clean antecedents of the petitioners, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 3rd cum Special Judge, Excise Act, Samastipur, in connection with Bithan P.S. Case No.10 of 2019, subject to the condition that both the bailors shall be close relative of the petitioners.
