2. This application is filed for quashing the order dated 22.01.2014 passed by learned Sub-Divisional Judicial Magistrate, Patna City in the Complaint Case No. 73 of 2014 and cognizance has been taken under Sections 323, 341, 504, 427, 379 and 384 of the Indian Penal Code.
3. As per prosecution story, the allegation against the petitioner is of demanding extortion money from the
Patna High Court CR. MISC. No.54056 of 2015(4) dt.03-08-2023 2/2 complainant.
4. From reading of the complaint, it appears that for a long standing dispute, this kind of false and frivolous case has been registered and filed against the petitioner. This kind of malicious prosecution should not be allowed to continue.
5. Accordingly, the order the order dated 22.01.2014 passed by learned Sub-Divisional Judicial Magistrate, Patna City in the Complaint Case No. 73 of 2014 is hereby quashed. (Sandeep Kumar, J) Sunnykr/- U T
