JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-10-2020 Heard Ms. Tulika Singh, learned counsel for the petitioner and Ms. Pushpa Sinha, learned APP for the State. The petitioner seeks bail in connection with Piro P.S. Case No. 80 of 2020, dated 21.03.2020, instituted for the offences under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b) A/26 of the Arms Act. Patna High Court CR. MISC. No.25988 of 2020(2) dt.13-10-2020 2/2 conducted. The petitioner and many others were arrested. From the possession of the petitioner, a loaded country made pistol and a mobile phone has been recovered. Learned counsel for the petitioner submits that apart from mobile phone, the petitioner was carrying nothing, but wrongly, recovery of a firearm has been shown from his possession.

The petitioner is in custody since 21.03.2020 and claims to be a person of clean antecedents.

Regard being had to the aforesaid facts, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 5th Addl. Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro P.S. Case No. 80 of 2020.

The application stands allowed.
