The petitioner claims that at the instance of the officials of Patna Municipal Corporation he had executed the work of excavation, cleaning of drains and manholes in Ward No. 9 and 21 of Serpentine Road. According to him, a bill for a sum of Rs. 1,84,600/- is payable to the petitioner by the Corporation, which is not being paid.

In response to a query made by this Court, learned

Patna High Court CWJC No.11248 of 2021(2) dt.07-03-2022 2/2 counsel for the petitioner has submitted that the work order was issued orally by the officials of the Corporation on the basis of which the petitioner had executed the work.

On the basis of what has been asserted in the writ application, in our view, no direction can be issued as sought for in the present writ application.

This writ application is, however, disposed of with a liberty to the petitioner to pursue his remedy before the authorities by making a fresh representation. If any representation is made by the petitioner before competent authority of the Corporation, it is expected that the same shall be considered in accordance with law.
