JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-02-2018 The petitioner seeks bail in anticipation of his arrest in connection with Warsaliganj P.S. Case No. 185 of 2017 dated 01.08.2017 instituted for the offences under Sections 447, 504, 506, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is alleged to have opened fire from his gun which led to injuries in the right eye of the informant.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated because of village politics and dispute over a plot of land. It has further been submitted that petitioner being in service, had been helping his uncle monetarily who had purchased a land from one of the cosharers of the informant. Despite that, the uncle of the petitioner had purchased the land from the co-sharer of the informant. Thereafter, with a view to teach the petitioner and his uncle a lession, the present case has been lodged.

Considering the nature of injury on the person of the informant which is opined to be simple and the background facts, this Court is inclined to grant anticipatory bail to the petitioner.

The petitioner, above named is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to his furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Nawadah in connection with Warsaliganj P.S. Case No. 185 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Ashutosh Kumar, J) Shageer/- U T
